29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) On or about October 21, 2022, employees working on the ground to perform cleanup and assisting the roofers who were working directly above re-roofing the structure, were not protected from struck by hazards from falling materials and tools by wearing a protective helmet.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about October 21 2022, employees operating pneumatic nail guns without  eye or face protection while installing shingles,  were exposed to struck by hazards that cause puncture wounds and potential blindness or eye injury.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) On or about October 21, 2022, employees conducting roofing activities (shingle installation) on a 16:12 pitch roof of the main house structure were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately twelve (12) feet on the East side of the structure and approximately 17 feet on the West side of structure.  (b)On or about October 21, 2022, employees conducting roofing activities (shingle installation) on a 16:12 pitch roof of the detached garage were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately Seventeen 17 feet on the East side of structure.  The Axel Guzman company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1621869, citation number 2, item number 1 and was affirmed as a final order on January 12, 2023, with respect to a workplace located at 1236 Allen Road, Oconomowoc, WI 53066.  The Axel Guzman company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1584193, citation number 1, item number 1 and was affirmed as a final order on June 10, 2022, with respect to a workplace located at N63 W13753 Bridal Wreath Court in Menomonee Falls, WI 53090.
