29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. a) 149 Lexington Place, Dover, DE 19901: On or about 10/21/2022, CSHO observed two employees walking, working and standing on a timber framed residential structure at heights greater than 20 feet. CSHO observed Mr. Duarte, Foreman/Owner and competent person, expose himself to the same hazard without regard for his safety or that of his employees. Mr. Duarte stated he was aware of the hazards, did not initiate frequent and regular inspections of working conditions, and made no effort to abate it.
