29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.  a) 149 Lexington Place, Dover, DE 19901: On or about 10/21/2022, CSHO observed two employees walking, working and standing on a timber framed residential structure at heights greater than 20 feet. CSHO observed Mr. Duarte, Foreman/Owner and competent person, expose himself to the same hazard without regard for his safety or that of his employees. Mr. Duarte stated he was aware of the hazards, did not initiate frequent and regular inspections of working conditions, and made no effort to abate it.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by a guardrail system, safety net system, or personal fall arrest system, or an alternative fall protection measure that meets a provision described in paragraph (b) of this section.  a) 149 Lexington Place, Dover, DE 19901: On or about 10/21/2022, CSHO observed three employees walking, working and standing on a timber framed residential structure at heights greater than 20 feet where there were no fall protection systems in place.

29 CFR  1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training or  when employer relied on training conducted by another employer, the certification record needs to indicate the date the employer determined the prior training was adequate rather than the date of actual training, and the signature of the person who conducted the training or the signature of the employer.   a) 149 Lexington Place, Dover, DE 19901: On or about 10/21/2022, CSHO observed employees working to frame a residential structure where they had not received appropriate training that would allow them to recognize and avoid the hazards associated with working at heights.
