OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck against hazards associated with the operation of heavy equipment.  a) 900 Mine Road Lebanon, PA - Job Site - On or about October 14, 2022, an employee was loading a HAMM Tandem Roller onto a transport trailer when the roller left the trailer, subsequently ejecting the employee from the roller's operator's seat and causing him to be thrown to the ground.  The employee was exposed to a struck-against hazard during the ejection as the operator's safety belt was not being utilized.

29 CFR 1926.21(b)(2):  The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:  a) 900 Mine Road Lebanon, PA - Job Site - On or about October 14, 2022, employees did not have training on the safe operations on the HAMM Tandem Roller with topics, including, but not limited to, the need to wear the operator's seat belt, and associated hazards of not wearing the operator's seat belt, including, but not limited to, ejection, rollover, struck-against and crush hazards.

29 CFR  1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  A.) 900 Mine Road Lebanon, PA - Job Site - On or about October 14, 2022, an employee sustained injuries requiring hospitalization as the result of an ejection from HAMM Tandem Roller, and the employer failed to report the hospitalization to the OSHA Area Office within 24-hours of the admission.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
