OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck by hazards. Location: Lonza Biologics 101C Construction Site On or about October 7, 2022, employees were exposed to struck by and crushing hazards when the Merlo ROTO70.28s Plus, all-terrain forklift, dropped a load of metal framing studs. Two synthetic web slings were used for rigging and one of the slings was severed when contacting a sharp metal edge and the load was dropped. The synthetic web slings were not protected from abrasion.

29 CFR 1926.251(e)(8):Synthetic web slings were not immediately removed from service if any of the following conditions specified in 1926.251(e)(8)(i) through (e)(8)(v) were present: (i) Acid or caustic burns; (ii) Melting or charring of any part of the sling surface; (iii) snags, punctures, tears, or cuts; (iv) broken or worn stitches; or (v) distortion of fittings. Location: Lonza Biologics 101C construction site On or about October 7, 2022, employees were not protected from struck by and crushing hazards where a damaged Penco, 16 foot, synthetic web sling was used for rigging and not removed from service.
