29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). a) 29279 U.S. Hwy 98 Daphne, AL: On or about October 25, 2022, and at times prior, the employer exposed employees to cave-in hazards in that employees were allowed to work inside of a trench approximately 5 feet 2 inches deep, approximately twelve 8 feet 8 inches wide, and approximately sixteen 31 feet 3 inches long, that was dug in class "C" soil. The employer had not complied with the standard in that employees were not protected from cave-ins by an adequate protective system and the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (thirty-four degrees measured to the horizontal).
