29 CFR  1926.451(c)(2)(v):Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied.  Employees engaged in residential construction activities at 12006 South 111th Street, Papillion, Nebraska 68046, were exposed to fall hazards in that the employees were working from an unsecured mobile platform.

29 CFR  1926.1052(c)(1)(ii):Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stair rail system along each unprotected side or edge.  Employees engaged in residential construction activities at 12006 South 111th Street, Pillion, Nebraska 68046, were exposed fall hazards in that employees were using a stairwell for access and egress to and from the 2nd level of the residential structure.  The stairwell in use was not equipped with hand rails.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.  The employer is failing to protect employees from fall hazards.  This was most recently documented on or about October 25th, 2022, at 12006 South 111th Street, in Papillion, Nebraska 68046.  Employees were observed working at heights greater than 6ft without fall protection.    Martin Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1548102, citation number 1, item number 3 and was affirmed as a final order on 10-25-21, with respect to a workplace located at 19821 Briar Street, Gretna, NE 68028.

29 CFR  1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  Employees engaged in residential construction activities at 12006  South 111th Street, Papillion, Nebraska 68046, were exposed to fall hazards in that they were working at heights greater than 6 feet without any fall protection.  The employer indicated that he has provided his employees with fall protection training, however, the employer indicated that he does not have  written certification that his employees have been trained.
