29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids, or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  At the commercial/ residential building project located at 16000 Ruth Street (MU 3 Project) in Parksville, Missouri, employees were exposed to struck-by hazards.  Employees engaged in framing activities using pneumatic nailers, Dewalt Saw Saw, and hand tools were exposed to struck-by hazards in that eye protection was not provided. Level Builders had the authority to correct and control the site as they were the General Contractor for the Project.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest system, nor were an employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   At the commercial/ residential building project located at 16000 Ruth Street (MU 3 Project) in Parksville, Missouri, an employer exposed employees to fall hazards.  The employer exposed employees to these hazards by allowing them to work at heights greater than 6 feet without fall protection or mitigation measures in place. Level Builders had the authority to correct and control the site as they were the General Contractor for the Project.

29 CFR  1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  At the commercial/ residential building project located at 16000 Ruth Street (MU 3 Project) in Parksville, Missouri, employees were exposed to fall hazards.  An employee was exposed to a serious fall hazard while using a type A step to work on the second floor of a balcony, the employee had the ladder closed and propped up against the wall and he was also facing away from the wall he was working on. Level Builders had the authority to correct and control the site as they were the General Contractor for the Project.
