29 CFR  1926.501(b)(4)(i):Each employee on walking/working surfaces shall be protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.  Employees engaged in residential construction activities at 5407 North 208th Street, Elkhorn, Nebraska 68022, were exposed to fall hazards in that employees were not protected from falling into a hole that led to the basement of the residential structure.  The hole was not protected by a personal fall arrest system, covers, or a guard rail system.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.  Employees engaged in residential construction at 5407 North 208th Ave, Elkhorn, Nebraska 68022, were exposed to fall hazards in that employees were working at heights greater than 6 feet and they were not protected by guard rail systems, safety net, or a personal fall arrest system.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  Employees engaged in residential construction at 5407 North 208th Ave, Elkhorn, Nebraska 68022, were exposed to fall hazards in that employees were using an extension ladder for access and egress to the uppermost level of the residential structure.  The extension ladder did not extend 3ft above the upper landing surface.

29 CFR  1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  Employees engaged in residential construction activities at 5407 North 208th Ave, Elkhorn, Nebraska 68022, were exposed to fall hazards in that they were working at heights greater than 6 feet without any fall protection.  The employer indicated that he has provided his employees with fall protection training, however, the employer indicated that he does not have  written certification that his employees have been trained.
