29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) On or about 10/26/2022, at a new residential home construction site located at 1 Carriage Lane West Seneca, NY, employees, without fall protection, were working on a two-story building roof. Employees were installing shingles on the roof of a gable end at a height of approximately 30 feet. There were no fall protection measures in place. NO ABATEMENT CERTIFICATION REQUIRED

Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. a) On or about 10/26/2022, at 1 Carriage Lane, West Seneca, NY; the employer did not enforce the use of fall protection for employees installing shingles 20 ft above lower levels. The employer allowed employees to work on elevated surfaces greater than 6 feet high without fall protection. NO ABATEMENT CERTIFICATION REQUIRED
