29 CFR 1910.1053(d)(1): The employer failed to assess the exposure of each employee who is or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option or the scheduled monitoring option. On or about October 18, 2022, the employer did not assess employees' exposure to respirable crystalline silica when sandblasting in the sandblasting area with Silica Sand that contained respirable crystalline silica dust.

29 CFR 1910.1200(e)(1)(i): The employer failed to maintain a list of the hazardous chemicals known to be present in the workplace using a product identifier that is referenced on the appropriate safety data sheet. On or about October 27, 2022, the employer failed to include hazardous chemical products that were onsite on the chemical inventory list. These products are used in various workplace operations including but not limited to welding, sandblasting and operating the forklift and include products including but not limited to Propane, Acetylene, Argon, Compressed Air, Oxygen, and Silica Sand.
