29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. On or about October 26, 2022 , employees were installing shingles on a apartment complex under construction using a pneumatic nail gun without eye protection, exposing employees to the hazard of being struck-by flying objects or debris.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction 6 feet (1.8 m) or more above lower levels were not protected from falling by the use of guardrail systems, safety net systems or personal fall arrest systems nor was an alternative fall protection plan which meets the requirements of 1926.502(k) developed and implemented: On or about October 26, 2022, employees were securing shingles to the roof of a new apartment complex under construction without the use of fall protection, exposing the employees to the hazard of falling approximately 35 feet to the ground.
