29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On 24 October 2022, six employees from Franky General Contracting, Inc. were observed working on a roof at 15302 Braefield Drive in Chesterfield, Missouri. They were not utilizing guardrail systems, a safety net system, or a personal fall arrest system. The employees were observed on the roof of the building without fall protection, exposing them to falls to the ground below.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. On or about 24 October 2022, six employees from Franky General Contracting, Inc. were working on a residential roof located at 15302 Braefield in Chesterfield, Missouri. The foreman and employees utilized a ladder that did not extend at least three feet above the roof they were accessing for work.
