29 CFR 1910.176(a): Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked. a) On or about October 24, 2022, the employer did not ensure that employees were protected from struck by hazards associated with material handling equipment in that the employer failed to ensure that aisles and passageways in the DFT and Wax & Dye Departments were appropriately marked.

29 CFR 1910.178(n)(6): The driver shall be required to look in the direction of and keep a clear view of the path of travel. a) On or about October 24, 2022, an employee was struck by a powered industrial truck (mechanical handling equipment) in an aisle of the DFT and Wax & Dye department at 53 Freedom Road, Painesville, Ohio 44077; the employer did not ensure the driver was looking in the direction of and keeping a clear view of the path of travel to prevent a struck by hazard.
