29 CFR 1910.134(f)(1): The employer shall ensure that employees using a tight-fitting facepiece respirator pass an appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT) as stated in this paragraph. a. Delaware OPCO, LLC. at 2270 Warrensburg Road, Delaware, OH 43015: On or about October 26, 2022, the employer did not provide a fit test to all employees required to wear respirators. The employer required employees to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents.

29 CFR 1910.134(k): Training and information. This paragraph requires the employer to provide effective training to employees who are required to use respirators. The training must be comprehensive, understandable, and recur annually, and more often if necessary. This paragraph also requires the employer to provide the basic information on respirators in Appendix D of this section to employees who wear respirators when not required by this section or by the employer to do so. a. Delaware OPCO, LLC. at 2270 Warrensburg Road, Delaware, OH 43015: On or about October 26, 2022, the employer did not provide respiratory protection training to all employees required to wear respirators.
