29 CFR  1910.266(h)(2)(i): Before felling is started, the feller did not plan and clear a retreat path.  a) Cutting area; On or about October 28, 2022, the employer did not ensure that an employee, who was manually felling a tree, had planned and cleared a retreat path. Retreat path was covered in heavy brush, vines, and cut trees that needed to be climbed over in order to  retreat.

29 CFR 1910.266(h)(2)(ii):  Before each tree is felled, conditions such as, but not limited to, snow and ice accumulation, the wind, the lean of tree, dead limbs, and the location of other trees, was not evaluated by the feller and precautions taken so a hazard is not created for an employee:  (a)  Logging Site, Cucumber, WV:  On October 28, 2022, an employee felled an approximately 85-foot-tall hickory tree located uphill from another approximately 85-foot-tall hickory tree.  The hickory tree was felled onto another hickory tree which caused the tree to break off and spring back up the hillside.   An evaluation was not conducted, and precautions were not taken by the feller prior to the hickory tree being felled to prevent struck-by hazards from near-by trees.

29 CFR  1910.266(f)(2)(viii): An employee other than the operator was riding a mobile vehicle without the use of a seatbelt or other protection equivalent to that provided for the operator.  a) Bulldozer and Skidder; On or about October 28, 2022, and times prior, the employer did not prevent employees from riding to and from the work area on the bulldozer and skidder without protection equivalent to that provided for the operator in that the employees riding on the equipment did not have a seat in the cab, a seatbelt, or rollover protection.

29 CFR  1910.266(h)(1)(iii): While manual felling is in progress, no yarding machine shall be operated within two tree lengths of trees being manually felled. Exception: This provision does not apply to yarding machines performing tree pulling operations.  a) Cutting area; On or about October 28, 2022, the employer did not prevent a skidder and the operator from being located within two tree lengths of a tree being manually felled in which the skidder operator was within 75 feet of the tree being felled.  b) Cutting area; On or about October 28, 2022, the employer did not prevent a bulldozer and the operator from being located within two tree lengths of a tree being manually felled in which the dozer operator was within 30-50 feet of the tree being felled.

29 CFR  1910.266(i)(10)(i): The employer did not verify compliance with paragraph (i) of this section by preparing a written certification record.  The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  If the employer relies on training conducted prior to the employee's hiring or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate.  a) Cucumber, WV; On or about October 28, 2022, and times prior, the employees training was not put into a written certification by the employer.
