29 CFR 1910.37(a)(3): Exit route(s) are not kept free and unobstructed:  Stock room: The employer did not ensure all exit routes were free and unobstructed, exposing employees to fire hazards: a) The fire exit in the stock room leading outside was blocked with a portable, expandable, roller conveyor with multiple boxes of merchandise on it. b)  The fire exit route in the retail space leading to the stock room was blocked with multiple boxes of merchandise.  The employer routinely fails to assure effective protection against fire hazard(s) as required by the standard, as demonstrated on or about October 31, 2022, when employees were not protected from fire hazard(s) due to the fire exits being blocked with material at 907 Boston Post Road, Unit B, Old Saybrook, CT 06475.  Dollar Tree Stores, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.37(a)(3), which was contained in OSHA Inspection Number 1569923, citation number 2, item number 1 and was affirmed as a final order on July 01, 2022, with respect to a workplace located at 152 Western Avenue Suite 2 Augusta, ME 04330.  To abate this violation, the employer must ensure that Fire exits remain clear and un-obstructed.    Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance; including an explanation of how these steps will protect employees from fire hazards, by maintaining exit routes, that may result in injuries.

29 CFR 1910.176(b): Material stored in tiers are not stacked, blocked, interlocked or limited in height so that it was stable and secure against sliding and collapse:  Stock room: The employer did not ensure that inventory stored in the stock room was stacked in a stable and secure manner to prevent sliding or falling exposing employees to struck-by and tripping hazards.  The employer routinely fails to assure effective protection against unsafe stacking of material as required by the standard, as demonstrated on or about October 31, 2022, when employees were not protected from struck-by hazards due to the unsafe stacking of material at 907 Boston Post Road, Unit B, Old Saybrook, CT 06475.  Dollar Tree Stores, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.176(b), which was contained in OSHA Inspection Number 1431460, citation number 1, item number 2 and was affirmed as a final order on April 05, 2021, with respect to a workplace located at 1041 Commonwealth Avenue, Boston, MA 02134.  To abate this violation, the employer must ensure that adequate stacking of material is maintained.   Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance; including an explanation of how these steps protect employees from struck-by hazards due to the unsafe stacking of material that may result in injuries.
