29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) On or about 11/28/2022, at the work site along Spencerport Road and Gates Manor Drive, located in Rochester, New York, the employer did not enforce the use of a safe means of egress such as a ladder, or ramp for employees working in a trench 5 feet 6 inches below grade. Employees were allowed to install new mains (sewer line laterals) inside a trench without establishing a safe method to exit the trench. NO ABATEMENT CERTIFICATION REQUIRED
