29 CFR 1910.95(c)(1):   A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8-hour time-weighted average sound level (TWA) of 85 dBA:   a)  In the Facility, on or about November 17, 2022 - The employer did not institute a continuing effective hearing conservation program when employee noise exposures exceeded an 8-hour time-weighted average sound level of 85 dBA.  An employee designated as a Foreman was exposed to noise at a level of 66.2% of the allowable limit during a 314 minute sampling period on November 17, 2022.   This exposure is equivalent to a sound level of 87.1 dBA for the dose and time of employee exposure and is 1.32 times in excess of the 85 dBA action level (50%) at which the hearing conservation program is required.  b)  In the Facility, on or about November 17, 2022 -  An employee designated as a Laborer in the Cutting Room was exposed to noise at a level of 71.8% of the allowable limit during a 331 minute sampling period on November 17, 2022.   This exposure is equivalent to a sound level of 87.6 dBA for the dose and time of employee exposure and is 1.44 times in excess of the 85 dBA action level (50%) at which the hearing conservation program is required.  c)  In the Facility, on or about November 17, 2022 -   An employee designated as a Laborer on Nailing Machine (Woodpecker) was exposed to noise at a level of 74.5% of the allowable limit during a 337 minute sampling period on November 17, 2022.   This exposure is equivalent to a sound level of 87.9 dBA for the dose and time of employee exposure and is 1.49 times in excess of the 85 dBA action level (50%) at which the hearing conservation program is required.  d)  In the Facility, on or about November 17, 2022 -   An employee designated as a Yard Operator/Maintenance was exposed to noise at a level of 80.5% of the allowable limit during a 330 minute sampling period on November 17, 2022.   This exposure is equivalent to a sound level of 88.4 dBA for the dose and time of employee exposure and is 1.6 times in excess of the 85 dBA action level (50%) at which the hearing conservation program is required.  e)  In the Facility, on or about November 17, 2022 -  An employee designated as a Laborer- Nail Room was exposed to noise at a level of 79.9% of the allowable limit during a 349 minute sampling period on November 17, 2022.   This exposure is equivalent to a sound level of 88.4 dBA for the dose and time of employee exposure and is 1.6 times in excess of the 85 dBA action level (50%) at which the hearing conservation program is required.  f)  In the Facility, on or about November 17, 2022 -   An employee designated as a Laborer - Saw Room was exposed to noise at a level of 113.6% of the allowable limit during a 345 minute sampling period on November 17, 2022.   This exposure is equivalent to a sound level of 90.9 dBA for the dose and time of employee exposure and is 2.27 times in excess of the 85 dBA action level (50%) at which the hearing conservation program is required.
