The employer did not establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment is isolated from the energy source and rendered inoperative. a) The Baler, Page Material Management, LLC dba Keith Titus Corporation, 2548 East Main St., Cato, NY 13033, on or about 10/29/2022: The employer permitted servicing and maintenance activities on equipment including, but not limited to, removing loose metal material from the piston area of the Baler while it was actively running, without establishing a lockout/tagout program inclusive of written energy control procedures, employee training, and periodic inspections, to prevent serious injuries from the unexpected energizing, start up or release of stored energy of the equipment.
