29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use. a) Lot #3 West Park Place Avenue, Inlet Beach, FL; On or about November 1, 2022, and at times prior thereto, the employer permitted employees to work from a job-made work platform that was being elevated by a JLG rough terrain forklift that was not approved for use by the manufacturer exposing the employees to fall hazards of up to 30 feet.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a) Lot 3 West Park Place Avenue, Inlet Beach, FL; On or about, November 1, 2022, and at times prior thereto, the employer exposed employees to approximately 30 feet fall hazards in that employees were allowed to perform roofing from the fourth level balcony which had an unprotected edge.
