29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system: (a) On or before May 17, 2022, the exposing employer did not ensure that employees were protected from injury, in that four employees worked near the edge of the flat roof of a two-story residential building and did not utilize a fall protection system. This condition exposed employees to fall hazards of approximately 25 feet. (b) On or before May 17, 2022, the exposing employer did not ensure that employees were protected from injury, in that four employees worked on exterior sections of the residential building that exposed the employees to a fall hazard of approximately 12 feet. Guardrails were not installed nor was personal fall protective systems used. Ladders were also placed in these areas to access the roof of the two-story building.
