29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    At the jobsite located at 827 Hemlock St. in Gardner Kansas, employees engaged in residential framing activities, walking the top plates, were exposed to fall hazards of approximately 9.5 feet to the exterior ground below in that fall protection was not utilized.  Omar Penaloza Benito was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1479631, citation number 1, item number 1 and was affirmed as a final order on September 14, 2020, with respect to a workplace located at 22636 W. 88th Lenexa, Kansas.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   At  the jobsite located at 827 Hemlock St. Gardner, Kansas, employees were exposed to fall hazards associated with ladders slipping in that the ladder did not extend 3 feet above the landing and was not secured.
