29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  Jobsite:  a) On or about November 2, 2022, the side rails on the extension ladder set up to access the left side porch roof did not extend at least 3 feet above the landing surface, exposing employees to a fall of approximately 10 feet.  b) On or about November 2, 2022, the side rails on the extension ladder set up to access right side porch roof did not extend at least 3 feet above the landing surface, exposing employees to a fall of approximately 10 feet.  c) On or about November 2, 2022, the extension ladder set up on the back gable end for access to the house roof was not extended at least 3 feet above the landing surface, exposing employees to a fall of approximately 12 feet to a lower porch roof and 25 feet to the ground.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by a guardrail system, safety net system, or personal fall arrest system, or an alternative fall protection measure that meets a provision described in paragraph (b) of this section.  Jobsite:  a.) On or about November 2, 2022, an employee  performing roofing work on a residential home was not protected from falls of approximately 10 feet from the porch roof and 20 feet from the main house roof where fall protection was not utilized.  b.) On or about November 2, 2022, employees were exposed to a fall of approximately 20 feet where the lifelines used on the roof appeared to be wrapped and tied around the roof framing with no anchors visible and were not capable of supporting at least 5,000 pounds.  c.) On or about November 2, 2022, employees installing plywood sheathing on the roof did not have the attachment point of their lifelines in the center of their backs and instead had the lanyards attached at D-rings on their waists.  Juan Mainato, Inc. was previously cited for a repeat violation of this occupational safety and health standard, which was contained in OSHA inspection number 1505045, citation number 2, item number 1 and was affirmed as a final order on March 16, 2021 , with respect to a workplace located at 193 Pearl St. in Manchester, NH.
