29 CFR  1926.20(b)(2):  The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of job sites, materials, and equipment to be made by a competent person(s).   Site: 840 Middle Country Rd. Nesconset, N.Y.  Building-north wall.   a)  On or about November 3, 2022, employees were dismantling a masonry wall from lifts.  The employer did not conduct an inspection of the wall by a competent person prior to the wall being demolished. A total of six (6) employees sustained injuries when the wall collapsed.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

Building-north wall.   a) On or about November 3, 2022,  The employer did not provide hazard recognition training  to employees performing demolition activities at a construction site.  Note:  In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

Site: 840 Middle Country Rd. Nesconset, NY.   a. Employees were not wearing protective helmets while engaged in demolition activities exposing to them head injuries; on or about 11/3/2022.   Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

Site: North side wall- 840 Middle Country Rd. Nesconset, N.Y.    a) Employees engaged in demolition activities were exposed to crush by hazards when a wall collapsed.  An engineering survey was not conducted by a competent person as required prior to the employer permitting employees to start demolition operations; on or about 11/03/2022.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
