29 CFR 1926.20(b)(2): The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.    a) 62 Senator's Way, Berlin NJ:  On or about  November 3, 2022,  MJ Lyons Corporation, a controlling and correcting employer for this jobsite, had not performed frequent and regular inspections of the worksite, by a competent person, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition(s).  As such, sub-contractor workers were performing roof shingle installation and other related activities from a residential structure's pitched roofs while improperly utilizing fall protection equipment and not using safety glasses while using air nailers.        NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
