29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about November 3, 2022, employees were operating  using pneumatic nail guns without eye protection while installing roof shingles, were exposed to struck by hazards that cause eye injury and/or loss of eye sight.

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  (a) On or about November 3, 2022, employees were working on the north side of an apartment building roof located at 251-273, 275-297 Oconomowoc Pkwy, Oconomowoc, WI 53066, conducting roofing work on an existing roof with a 3:12 pitch, were not wearing fall protection. This exposed employees to a fall hazard of approximately 28 feet from the apartment complex roof to the ground below.

29 CFR  1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  (a) On or about November 3, 2022, Employees were working on north side of an apartment roof at 251-273, 275-297 Oconomowoc Pkwy, Oconomowoc, WI 53066 conducting roofing work on an existing roof with a 14:12 pitch, were not wearing fall protection. This exposed employees to a fall hazard of approximately 28 foot fall to the ground below.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) On or about November 3, 2022, the employer did not ensure that employees exposed to potential fall hazards had been trained to recognize and minimize the fall hazards associated with their work.
