29 CFR  1910.28(b)(1)(i): Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following as identified in 29 CFR 1910.28(b)(1)(i)(A) - 1910.28(b)(1)(i)(C).  On or about and at times prior to December 6, 2022, at the establishment located at 1325 West Fernau Avenue, Oshkosh, Wisconsin; in the Weld Shop, the employer did not ensure that an employee on a walking-working surface with an unprotected side or edge that was greater than 4 feet above a lower level was protected from falling by guardrail systems, safety net systems or personal fall protection systems, exposing an employee to fall hazards while working on the pit platform.

29 CFR  1910.29(b)(13)(i): When guardrail systems are used around holes that serve as points of access (such as ladderways), the guardrail system opening shall have a self-closing gate that slides or swings away from the hole, and is equipped with a top rail and midrail or equivalent intermediate member that meets the requirements in paragraph (b) of this section.  On or about and at times prior to December 6, 2022, at the establishment located at 1325 West Fernau Avenue, Oshkosh, Wisconsin; at the Weld Shop, the employer did not ensure that the point of access into the Pit consisted of a self-closing gate, exposing an employee to fall hazards. The depth of the Pit was measured to be greater than eight feet.

29 CFR  1910.212(a)(1): One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  At the establishment located at 1325 West Fernau Avenue, Oshkosh, Wisconsin; the employer did not provide one or more methods of machine guarding to protect the operator and other employees in the machine area in the following instances:  a) The TL-40B 124 (MFG NO 1771) CNC lathe was not guarded during operation to prevent entry into the machine, exposing employees to caught-in and entanglement hazards. b) The TL-40B 1980 (SN 1980) CNC lathe was not guarded during operation to prevent entry into the machine, exposing employees to caught-in and entanglement hazards. c) The rotating chuck of the TOS engine lathe was not guarded during operation to prevent contact with the rotating chuck, exposing employees to caught-in and entanglement hazards. d) The operator was not protected while polishing a part with emery cloth or sand paper on the TOS engine lathe, exposing an employee to caught-in and entanglement hazards.
