29 CFR  1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated.  a. On or about November 2, 2022, at the above addressed jobsite, an employee performing painting operations from a JLG 450AJ aerial lift was not wearing a body belt or full body harness. The employee was thereby exposed to the hazards associated with falls of approximately ten (10') feet four (4") inches.

29 CFR  1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  a. On or about November 2, 2022, at the above addressed jobsite, an employee had been provided fall training, however, the employer failed to keep a written certification record of the training.
