29 CFR 1917.95(b)(1): The employer did not provide and direct the wearing of personal flotation devices for those employees engaged in work in which they may be pulled into the water.  a) 1 Hausel Road Berth #3 Wilmington, De. 19801: On or about, November 4, 2022, employee was fueling Tugboat "Sally" moored at berth from the dock's edge over the bull noise to the tugs portside onboard the vessel. Employee was observed near the edge of dock without wearing a personal flotation device (PFD). Employee on the dock were not wearing approved personal floatation devices while conducting fueling. This condition exposed employee to a fall /drowning hazard.

29 CFR 1904.33(a):The employer did not save the OSHA 300 Log, the privacy case list (if one exists), the annual summary, and the OSHA 301 Incident Report forms for five (5) years following the end of the calendar year that these records covered.  a) 1 Hausel Road Berth #3 Wilmington, De. 19801: On or about, November 4, 2022, The employer had not maintained the log of all Work-Related Injuries and Illnesses (OSHA Form 300), the Summary of Work-Related Injuries and Illnesses (OSHA Form 300-A), and the Injury and Illness Incident Report (OSHA Form 301) for the years of 2018 through 2021.
