29 CFR 1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: At the worksite located at 6050 Manchester Trafficway Raytown, MO 64133: Employees engaged in manufacturing activities were exposed to injury/illness from dermal, ingestion, and inhalation hazards from exposure to chemicals. The employer had not developed or implemented a written hazard communication program to ensure that employees were aware of the hazards associated with the chemicals with which they work.

29 CFR 1910.1200(e)(2):The employer that produced, used, or stored hazardous chemicals at the workplace in such a way that employees of other employer(s) could be exposed did not ensure that the hazard communication program included all of the elements outlined in 29 CFR 1910.1200(e)(2)(i) through 29 CFR 1910.1200(e)(2)(iii): At the worksite located at 6050 Manchester Trafficway Raytown, MO 64133: Employees of Focus Partners were exposed to dermal, ingestion, and inhalation hazards from chemicals from a hazard communication program that did not include information regarding chemicals used in Next Wave. This included three unlabeled spray bottles located in Next Wave that were used by an employer representative of Focus Partners during the walkaround and a written program that did not included access to SDSs of chemicals used by Next Wave for Focus Partners.
