29 CFR 1910.134(a)(1): In the control of those occupational diseases caused by breathing air contaminated with harmful dusts, fogs, fumes, mists, gases, smokes, sprays, or vapors, the primary objective shall be to prevent atmospheric contamination. This shall be accomplished as far as feasible by accepted engineering control measures (for example, enclosure or confinement of the operation, general and local ventilation, and substitution of less toxic materials). When effective engineering controls are not feasible, or while they are being instituted, appropriate respirators shall be used pursuant to this section: On or about November 8, 2022, at the establishment located at 1434 Post Road, Plover, Wisconsin, a Master Operator working on the P1 Line was not required to wear respiratory protection when exposed to airborne breading dust above the Particulate Not Otherwise Regulated (PNOR) 8 hour Time Weighted Average Total Dust Exposure Limit of 15 mg/M3.

29 CFR 1910.1000(a)(2): Other substances -- 8-hour Time Weighted Averages. An employee's exposure to any substance in Table Z-1, the exposure limit of which is not preceded by a "C", shall not exceed the 8-hour Time Weighted Average given for that substance any 8-hour work shift of a 40-hour work week: On or about November 8, 2022, at the establishment located at 1434 Post Road, Plover, Wisconsin, a Master Operator working on the P1 Line was exposed to airborne breading dust above the Particulate Not Otherwise Regulated (PNOR) Total Dust 8 hour Time Weighted Average Exposure Limit of 15 mg/M3. The Master Operator was exposed to a 3.5 hour Time Weighted Average of 40 mg/M3 which is equivalent to an 8 hour Time Weighted Average of 17.5 mg/M3 assuming zero exposure for the remaining 4.5 hours of the work shift.

29 CFR 1910.1000(e): To achieve compliance with paragraphs (a) through (d) of this section, administrative or engineering controls must first be determined and implemented whenever feasible. When such controls are not feasible to achieve full compliance, protective equipment or any other protective measures shall be used to keep the exposure of employees to air contaminants within the limits prescribed in this section. Any equipment and/or technical measures used for this purpose must be approved for each particular use by a competent industrial hygienist or other technically qualified person. Whenever respirators are used, their use shall comply with 1910.134: On or about November 8, 2022, at the establishment located at 1434 Post Road, Plover, Wisconsin, a Master Operator working on the P1 Line was exposed to airborne breading dust above the Particulate Not Otherwise Regulated (PNOR) Total Dust 8 hour Time Weighted Average Exposure Limit of 15 mg/M3. The Production Line P1 exhaust and makeup air units along with the portable vacuum unit attached to Breader Unit #3 did not maintain the airborne dust concentration below the Particulate Not Otherwise Regulated (PNOR) Total Dust 8 hour Time Weighted Average Exposure Limit of 15 mg/M3.
