29 CFR 1910.1200(j)(2)(ii): The employer did not update their written hazard communication program required by paragraph (h)(1) by June 1, 2016 to reflect changes in labeling and safety data sheets. (a) On or about November 9, 2022, employees engaged in metal fabrication, were exposed to hazardous materials, such as but not limited to, lubricants, propane, and cleaning chemicals. The employer had not updated their Hazard Communication program, which would address labeling and other forms of warnings on hazardous material containers, Safety Data Sheets, and employee information and training on the hazards associated with the chemicals utilized on site to be consistent with the Globally Harmonized System (29 CFR 191200(a)(1)). The written program must also contain the following: 1. A list of all hazardous materials on site; 2. The methods the employer will use to inform employees of the hazards associated with non-routine tasks involving hazardous materials, such as spills; 3. The hazards of the materials contained in piping that is not labeled, and; 4. The method the employer will use to inform other employers (contractors) of the chemicals their employees might be exposed to while performing duties at the site.
