29 CFR  1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  a) All Ohio Masonry Restoration, LLC located at 1559 Northwest Blvd Columbus, OH 43212: On and preceding November 9, 2022, the employer did not ensure that employees working in areas below tools and materials wore head protection.  A masonry crew was working on the fifth tier of a five-tier scaffold approximately 21 feet above ground level and on the roof of the home while other personnel were at ground level and/or using the scaffolding as a means of access/egress without any form of head protection as they were positioned beneath the work taking place.  The following condition exposed employees to struck-by hazards.

29 CFR  1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.  a) All Ohio Masonry Restoration, LLC located at 1559 Northwest Blvd Columbus, OH 43212: On and preceding November 9, 2022, the employer did not ensure that toeboards were installed on the working levels of scaffolding that was being used as a work platform and as the primary means of access to the roof of the building. A masonry crew was working on the fifth tier of a five-tier scaffold approximately 21 feet above ground level without toeboards installed to prevent tools and materials from falling to the lower level as other employees stood on ground level and ascended/descended the scaffold for roof access.  The following condition exposed employees to struck-by hazards.

29 CFR  1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)  a) All Ohio Masonry Restoration, LLC located at 1559 Northwest Blvd Columbus, OH 43212: On and preceding November 9, 2022,  the employer did not ensure that all working levels of the scaffold was fully planked or decked between the front uprights and the guardrail supports. A masonry crew was working on a five-tier scaffold approximately 21 feet above ground level with a no less than half of the space between uprights unplanked on each level of the scaffolding. The fifth tier where work was being performed from had a gap of more than 36 inches between uprights on the outside section of the scaffold. The following condition exposed employees to fall hazards.

29 CFR  1926.451(e)(6)(vi): Integral prefabricated scaffold access frames being used for access had a spacing greater than 16 3/4 inches.   a) All Ohio Masonry Restoration, LLC located at 1559 Northwest Blvd Columbus, OH 43212: On and preceding November 9, 2022, the scaffolding frame used for accessing the upper levels of the scaffold and roof of the home was spaced more than 16 3/4 inches on the outside section being climbed. A masonry crew was working on the fifth tier of a five-tier scaffold approximately 21 feet above ground level with planks blocking the frame pieces that were uniformly spaced less than 16 3/4 inches.  When ascending/descending the scaffold the employees used the outside section of the frame that was spaced 44 inches to ascend/descend the scaffold. The following condition exposed employees to fall hazards.

29 CFR  1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.   a) All Ohio Masonry Restoration, LLC located at 1559 Northwest Blvd Columbus, OH 43212: On and preceding November 9, 2022, the employer did not ensure that employees working on scaffolding more than 10 feet above the lower level were protected from falls.  A masonry crew was working on a five-tier scaffold approximately 21 feet above ground level with a no guardrails installed on the open sides of the scaffold nor was any other form of fall protection in place to protect employees from falling.  The following condition exposed employees to fall hazards.

29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.   a) All Ohio Masonry Restoration, LLC located at 1559 Northwest Blvd Columbus, OH 43212: On and preceding November 9, 2022, the employer did not ensure that employees working on a two-story residential building at heights exceeding 18 feet were protected from falls.  A masonry crew was working on a chimney located near the center of a hip roof with an 18-foot eave and a slope of approximately 6/12 without any form of fall protection being utilized.  The following condition exposed employees to fall hazards.
