29CFR1926.21(b)(2) The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On or about November 9, 2022, during the repair and replacement of a broken water line at a worksite located at 17840 Bagley Road, Middleburg Heights, Ohio, the employer did not ensure an employee working inside a trench, with a depth of approximately 6 feet, was protected from cave-in hazards by an adequately designed protective system. The soil would have been classified as; Type "B", previously disturbed, cohesive soil.
