29 CFR  1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence as required by 29 CFR 147(d)(1) through (d)(6).  On or about October 24, 2022, employees were exposed to machine hazards associated with in going nip points while trying to clear material wrapped around the pinch rolls at the cooling area of the extrusion line. The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform the material clearing work [per the 1910.147 (d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], and verification of isolation[(d)(5)], were not implemented to protect employees from the machine maintenance hazards while clearing the material from the pinch roller.

29 CFR  1910.212(a)(1):Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are - barrier guards, two-hand tripping devices, electronic safety devices, etc.  On or about October 24, 2022, guarding was not in place to protect employees from ingoing nip points at the cooling section of the extrusion line.

29 CFR  1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  The employer did not report an employee hospitalization within 24 hours of being aware of the hospitalization. On or about October 24, 2022, an employee was hospitalized after their arm was caught in a pinch roller.
