29 CFR  1910.178(l)(1)(i): Safe Operation. The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  a) On or before November 8, 2022, the employer did not ensure that each powered industrial operator was competent to operate the Yale Hyster 90 GLP050RGNUAE090 at Clarke Power Services in that some employees only received the classroom training and were using the powered industrial truck based on previous training at different companies. Employees used the powered industrial truck to get materials off of delivery trucks and to move material such but not limited to truck parts around the maintenance area.

29 CFR  1910.242(a): Hand and Portable Powered Tools and Other Hand-Held Equipment- General requirements. Each employer shall be responsible for the safe condition of tools and equipment used by employees, including tools and equipment which may be furnished by employees.  a)  On or about November 1, 2022, the employer did not ensure the safe condition of the tool that were furnished by employees in that an employee used a personal pneumatic sander with a grinding wheel while shaving a truck rubber bumper stop. The wheel came apart, and struck the employee in the left arm.

29 CFR  1910.243(c)(1):General requirements. Abrasive wheels shall be used only on machine provided with safety guards as defined in paragraph (c) (1) through (4) of this section.  a) On or about November 1, 2022, the employer did not ensure the abrasive grinding wheel used on portable tools such as but not limited to, the portable air sander, was guarded. An employee used an abrasive grinding wheel on the portable air sander without a guard while shaving a truck trailer rubber bumper stop. The grinding wheel came apart, and struck the employee in the left arm.

29 CFR  1910.253(b)(2)(ii): Storage of Cylinders - General Inside of buildings, cylinders shall be stored in a well-protected, well-ventilated, dry location, at least 20 (6.1 m) feet from highly combustible materials such as oil or excelsior. Cylinders should be stored in definitely assigned places away from elevators, stairs, or gangways. Assigned storage spaces shall be located where cylinders will not be knocked over or damaged by passing or falling objects, or subject to tampering by unauthorized persons. Cylinders shall not be kept in unventilated enclosures such as lockers and cupboards.  a)  On November 8, 2022, the employer did not ensure that the Argon and Oxygen cylinders were not secure from being struck by or knocked over while located next to the doors between bays 3E and 4E where trucks were pulled in and out for maintenance.  b) On November 8, 2022, the employer did not ensure that the Argon cylinder was not secure from being struck by or knocked over while located next to the door of maintenance bay 4E where trucks were pulled in and out for maintenance.  c)  On November 8, 2022, the employer did not ensure that the Acetylene cylinder was not secure from being knocked over by employees located next to the drill press in maintenance bay 4E.
