29 CFR 1926.1153(c)(1):29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1: Worksite located at 4200 Hwy 13 Blvd., Higginsville, Missouri- Employees were exposed to silica respiratory hazards in that the employees had cut the expansion joints with a saw and then used a land scaping blower to blow excess dust from the expansion joints that he had cut and was not using any engineering controls or work practices to eliminate the hazards associated with silica dusts.

29 CFR 1926.1153(i)(2)(i)(B): The employer did not ensure that each employee covered by this section could demonstrate knowledge and understanding of specific tasks in the workplace that could result in exposure to respirable crystalline silica: Worksite located at 4200 Hwy 13 Blvd., Higginsville, Missouri- Employees were exposed to silica respiratory hazards in that the employees had cut the expansion joints with a saw and then used a land scaping blower to blow excess dust from the expansion joints that he had cut and was not using any engineering controls or work practices to eliminate the hazards associated with silica dusts. Employees need to be trained and demonstrate knowledge in the use of proper engineering controls and work practice controls and the implementation of using a wet method of cutting expansion joints and using water to removed the excess materials when resulting in exposure to respirable silica.
