OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: a) On or about January 26, 2023, in Elevator H, employees used the manlift to access working levels of the grain elevator. Employees were exposed to falls greater than 6-feet in that fall protection was not provided at the landings. b) On or about November 9, 2022, in Elevator H, employees were exposed to falling from the manlift that had deficiencies such as, but not limited to a bad switch and rope that would not stop the manlift, a belt splice that was dry rotted and split, and the red indicator light at the top was out The lift was not taken out of service until the repairs were made.
