29 CFR 1926.1053(b)(16): Portable ladder(s) with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, shall either be immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired. (a) Location - 411 Kenoza Street, Haverhill, MA; On or about 11/09/2022, a portable extension ladder that had damaged rungs was not withdrawn from service.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. (a) Location - 411 Kenoza Street, Haverhill, MA; On or about 11/09/2022, employees were not protected against falls of greater than 6 feet above a lower level. The Top Notch General Contracting, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1564792, citation number 1, item number 1 and was affirmed as a final order on 02/23/2022, with respect to a workplace located at 370 Gile Street, Haverhill, MA.
