29 CFR  1926.453(b)(2)(v): A body belt was not worn and a lanyard was not attached to the boom or basket when working from an aerial lift:   a) Job site, 900 Art Rooney Avenue, Pittsburgh, PA: On or about November 10, 2022, while adding branches to an outdoor seasonal decorative tree structure, the employer did not ensure that employees in the basket of an aerial lift used appropriate fall protection systems/devices while working at a height of approximately 15 feet.    Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).

29 CFR  1926.501(b)(15):  Except as provided in 1926.500(a)(2) or in 1926.501 (b)(1) through (b)(14), each employee on a walking/working surface 6 feet (1.8 m) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system:    a) Job site, 900 Art Rooney Avenue, Pittsburgh, PA: On or about November 10, 2022, while adding branches to an outdoor seasonal decorative tree structure, the employer did not ensure that an employee was protected from a fall hazard of up to approximately 15 feet while standing on and working from the tubular frame structure of the tree.

29 CFR  1926.503(c):  When the employer had reason to believe that any affected employee who had already been trained did not have the understanding and skill required by paragraph (a) of this section, the employer did not retrain each such employee:   a) Job site, 900 Art Rooney Avenue, Pittsburgh, PA: On or about November 10, 2022, prior to adding branches to an outdoor seasonal decorative tree structure, the employer did not ensure that an employee received appropriate fall protection retraining that would allow him to identify and follow safe work practices in that he worked on the tree structure and transferred laterally into the basket of an aerial lift without appropriate fall protection systems/devices in use, exposing him to a fall hazard of approximately 15 feet.
