29 CFR 1910.134(f)(2): The employer did not ensure that an employee(s) using a tight-fitting respirator was fit tested prior to initial use of the respirator, and at least annually thereafter; a) Newport News Shipbuilding, MOF Building, Bay 2 worksite: On or around 11/10/22, and times prior thereto, employees performed work under respirable crystalline silica controls, requiring N95 respirators for respiratory protection. These employees had not been fitted tested for N95 respirators prior to performing the work. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.134(g)(1)(i)(A): The employer did not prohibit a tight-fitting facepiece to be worn by employees who had facial hair that comes between the sealing surface of the facepiece and the face: a) Newport News Shipbuilding, MOF Building, Bay 2 worksite: On or around 11/10/22, and times prior thereto, employees performed work under respirable crystalline silica controls, requiring N95 respirators for respiratory protection. These employees were observed with significant facial hair in locations which would interfere with the seal of the respirator. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section: a) Newport News Shipbuilding, MOF Building, Bay 2 worksite: On or around 11/10/22, and times prior thereto, handheld grinders were used for slurry removal without a dust collection system. This resulted in visible clouds of dust being produced by the operation, which employees and the employees of neighboring contractors were exposed to. b) Newport News Shipbuilding, MOF Building, Bay 2 worksite: On or around 11/10/22, and times prior thereto, insufficient water was applied during the wet methods for slurry removal and the use of chipping hammers, to prevent significant amounts of visible dust from being released during the operations. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
