29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:  a) Newport News Shipbuilding, MOF Building, Bay 2 worksite: On or around 11/10/22, and times prior thereto, handheld grinders were used for slurry removal without a dust collection system.  This resulted in visible clouds of dust being produced by the operation, which employees and the employees of neighboring contractors were exposed to.    b) Newport News Shipbuilding, MOF Building, Bay 2 worksite: On or around 11/10/22, and times prior thereto, insufficient water was applied during the wet methods for slurry removal and the use of chipping hammers, to prevent significant amounts of visible dust from being released during the operations.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
