29 CFR 1910.29(b)(1): The employer did not ensure that guardrail systems met the requirement that the top edge height of top rails, or equivalent guardrail system members, that are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D11 of this section). a. On or about November 15, 2022, in the mezzanine area, the employer did not ensure the top edge of the guardrail was forty-two (42) inches in height, plus or minus 3 inches. The mezzanine guardrail measured height was approximately thirty-eight (38) inches. Employees were thereby exposed to fall hazards.

On or about November 15, 2022, in the mezzanine area, the employer did not ensure a midrail was installed on the guardrail throughout the mezzanine area. Employees were thereby exposed to fall hazards.
