OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to impact and/or caught-between hazards while operating high lift trucks. On or about November 16, 2022, the employer did not ensure employees working from a Crown SP (Model # SP3505-30) Stock Picker Lift Truck and a Hyster (Model # R30XMS3) Lift truck at heights below four feet were wearing and utilizing harness with lanyard attached to designated anchor point(s) exposing employees to the hazards associated with tip over and collision incidents.
