29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  On or about April 21, 2023, the employer failed to submit documentation and certification of corrective action for citation 1, item 1 issued on January 4, 2023 with the abatement due date of January 24, 2023.  On or about April 21, 2023, the employer failed to submit documentation and certification of corrective action for citation 2, item 1 issued on January 4, 2023 with the abatement due date of January 24, 2023.  On or about April 21, 2023, the employer failed to submit documentation and certification of corrective action for citation 2, item 2 issued on January 4, 2023 with the abatement due date of January 24, 2023.

29 CFR  1926.1053(b)(5)(i): Non-self-supporting ladder(s) were not used at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support).  On or about November 16, 2022, at a residential jobsite, an extension ladder was not set at the proper angle (4:1 ratio) when leaned against the wall. This condition exposed employees to fall hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:    On or about November 16, 2022, employees engaged in residential construction activities were exposed to fall hazards in excess of 6-feet without using any form of fall protection.  Rivas Construction & Roofing was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1346375, citation number 1, item number 1 and was affirmed as a final order on October 29, 2018, with respect to a workplace located at 816 De Leon El Paso, TX 79912.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.      On or about November 16, 2022, employees engaged in roofing operations were exposed to fall hazards in excess of 6-feet due to in adequacies in fall protection training.  Rivas Construction & Roofing was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.503(c)(3), which was contained in OSHA inspection number 1346375, citation number 1, item number 2 and was affirmed as a final order on (October 29, 2018), with respect to a workplace located at 816 De Leon El Paso, TX 79912.
