29 CFR 1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  On or about November 15, 2022, The employer did not ensure that an employee working inside an excavation at approximately eight feet in depth was  using head protection. Employee was exposed to struck- hazards from debris and other head injuries.   Abatement documentation  is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress shall be  located in trench excavations that are 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:   On or about November 15, 2022, an employee inside the trench did not have safe access to trench, exposing the employee to hazards  associated with not having safe access to trench and the employer did not ensure safe access was available for use.  Trench was approximately eight feet in depth.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR  1926.651(k)(1):An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  On or about November 15, 2022 , Employees were exposed to cave-ins and other hazards associated with working in and around the excavation that had not been inspected by a competent person.   No abatement certification or documentation is required for this item.

29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  On or about November 15, 2022, Employee was not protected by a adequate  protective system.  There was unprotected sections of an eight foot excavation, exposing employee to hazards associated with cave-in.  Employer did not ensure adequate cave-in protection was utilized when employees were working in a excavation .   Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19( d).

29 CFR 1926.652(c)(2)(iii): Manufacturer's specifications, recommendations, and limitations, and manufacturer's approval to deviate from the specifications, recommendations, and limitations shall be in written form at the jobsite during construction of the protective system. After that time this data may be stored off the jobsite, but a copy shall be made available to the Secretary upon request.  On or about November 15, 2022,  the employer did not maintain a copy of the tabulated data sheet of the trench box utilized when employees engaged in excavating activities, nor was it provided upon request. The trench box was not of adequate size for the excavation.   Abatement certification  is required for this item in accordance with 29 CFR 1903.19(c).
