29 CFR  1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:   a) Smith & Associates Excavating LLC located at 5786 Inlet Point Lane, Westerville, OH 43081:  On and preceding November 16, 2022, the employer failed to ensure cave-in protection was provided for employees working in an open trench, that was more than 6 feet in depth thereby exposing the employees to struck-by and caught-in hazards.  Smith & Associates Excavating LLC was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1590812, citation number 1, item number 1-b and was affirmed as a final order on June 17, 2022, with respect to a workplace located at Lot # 11 Hamlet Court, DUBLIN, OH 43017.  Smith & Associates Excavating LLC was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1306587, citation number 2, item number 1 and was affirmed as a final order on May 16, 2018, with respect to a workplace located at  7562 Lewis Center Road, WESTERVILLE, OH 43082.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Smith & Associates Excavating LLC located at 5786 Inlet Point Lane, Westerville, OH 43081:  On and preceding November 16, 2022, the employer did not ensure that employees engaged in tasks presenting struck-by hazards to the eyes wore appropriate eye protection.  Employees were using a Husqvarna K770 Power Cutter to cut sections of pipe for a residential sewer tie-in without utilizing any form of eye protection thereby exposing employees to struck-by hazards to the eyes.

29 CFR  1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.   a) Smith & Associates Excavating LLC located at 5786 Inlet Point Lane, Westerville, OH 43081:  On and preceding November 16, 2022, the employer did not ensure that an adequate means of egress was provided for an employee working in a residential sewer line trench which was over 6 feet deep and 55 feet in length. The following condition exposed employees to struck-by and caught-in hazards.  Smith & Associates Excavating LLC was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 1590812, citation number 1, item number 1-a and was affirmed as a final order on June 17, 2022, with respect to a workplace located at Lot # 11 Hamlet Court, DUBLIN, OH 43017 .
