A sub-contractor employee was exposed to struck-by hazards while working on foot in the area close proximity to where heavy equipment being operated. This resulted in the fatal struck-by injury of an employee.

29 CFR 1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury. a) On or about November 15th, 2022, the creating employer did not ensure employees were instructed in the recognition and avoidance of unsafe conditions involving struck-by hazards associated with employees working on foot in proximity to heavy equipment in operation. This resulted in the fatal struck-by injury of a worker on site.
