29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a. On the balcony at a residence, located at 22 South Tenth Avenue, Florida: On or about 11/17/2022, the controlling employer, Mulligan Contracting, Inc., failed to ensure that its sub-contractor, Moreka Services, Inc., protected its employee from fall hazards ranging from 6 to 20-feet, in that the employee was not protected from falling off the balcony as he worked on the balcony.
