29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): a) Building 3 and building 5: On November 17, 2022 and times prior the controlling employer, Stack Construction did not have an effective system in place to identify and correct hazards to which their subcontractors employees were exposed. Hazards include a 19-foot fall to the ground below when working near open sided floors and unprotected sides or edges without fall protection. b) Building 3: On November 17, 2022 and times prior the controlling employer, Stack Construction did not have an effective system in place to identify and correct hazards to which their subcontractors employees were exposed. Hazards included using an extension ladder that did not extend three rungs above the landing. Note) Certification of corrective action is required for these items.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501: a) Building 3 and building 5; On November 17, 2022 and times prior, the controlling employer Stack Construction did not ensure the framing sub-contractor protected its employees from fall hazards while performing framing activities on the upper deck of building 3 and near an open sided floor on building 5. The employees worked without fall protection and were exposed to fall hazards up to 19 feet to a lower level and the ground below. Note) Corrected during inspection.

The ladder did not extend beyond the landing surface. Note) Abatement certification is required for this item.
