29 CFR 1910.1001(j)(3)(i): The building owner, facility owner, or employer did not determine the presence, location, and quantity of ACM or PACM at the worksite and did not exercise due diligence in complying with these requirements to inform employers and employees about the presence and location of asbestos-containing material (ACM) and presumed asbestos containing material (PACM): On or about November 18, 2022 -Little El Fassi LLC, located at 31 West 34th Street, New York, NY 10001 a) Employees performing housekeeping tasks in the basement were exposed to the hazards of asbestos found in thermal system insulation (TSI) material surrounding pipes that contains 25-40% asbestos in the form of chrysotile. The employer did not fulfill its duties to determine the presence, location and quantity of ACM and/or PACM at the worksite. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1910.1001(j)(7)(iv): The employer did not provide to all employees who perform housekeeping operations in areas where ACM and/or PACM is present, an asbestos awareness training course which contained the following elements: the health effects of asbestos, locations of ACM and PACM in the building/facility, recognition of ACM and PACM damage and deterioration, requirements in this standard related to housekeeping, and/or proper response to fiber release episodes, at least once a year. On or about November 18, 2022 - Little El Fassi, LLC located at 31 West 34th Street, New York, NY 10001 a) Employees performing housekeeping tasks in the basement were exposed to the hazards of asbestos found in thermal system insulation (TSI) material surrounding pipes that contains 25-40% asbestos in the form of chrysotile. The employees did not receive any asbestos awareness training. The employer did not provide asbestos awareness training course to employees performing housekeeping operations in areas containing ACM or PACM. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
